Ohio Ruling Sets Stage for Supreme Court Decision on Early Voting

Ohio Secretary of State Jon Husted (R) said today he will ask the U.S. Supreme Court to decide whether state officials or federal courts should decide the particulars of early voting rules in the swing state.

A federal appellate court on Friday blocked changes made to Ohio’s early voting rules that allowed some military voters to cast ballots in the three days before Election Day but did not grant the same privilege to nonmilitary voters.

Though legal experts agreed that Husted had the authority to set uniform election standards so long as they do not differentiate between military and nonmilitary voters, he said the federal courts should not meddle with how states run their elections.

“This is an unprecedented intrusion by the federal courts into how states run elections and because of its impact on all 50 states as to who and how elections will be run in America we are asking the Supreme Court to step in and allow Ohioans to run Ohio elections,” Husted said in a prepared statement.

Early voting is popular in the Buckeye State, where both President Barack Obama and Republican presidential nominee Mitt Romney are campaigning heavily. In 2008, about 1.7 million Ohioans — more than 20 percent of the state’s registered voters — cast their ballots before Election Day. In 2010, polls showed that nearly a third of early voters cast their ballots within one week of Election Day, according to the appellate court ruling.

Friday’s opinion by a three-judge panel of the U.S. Court of Appeals for the Sixth Circuit is the latest legal tussle over changes to Ohio’s early voting rules.

The dispute began when Gov. John Kasich (R) last summer signed a measured passed by the Republican-controlled Ohio Legislature that ended early voting for all voters during the three days before Election Day. A series of legislative maneuvers to amend the law, including a referendum to repeal the initial measure, followed. Eventually, Ohio voters were left with conflicting statutes that ended the early voting period on the Friday before Election Day but also said that military voters could continue voting until Nov. 6.

“To make a long story short, the Legislature made a real mess of our early voting law,” said Daniel Tokaji, a law professor at Ohio State University.

To allay the confusion, Husted, as the state’s chief election official, interpreted Ohio law as setting an absolute deadline of 6 p.m. Friday for nonmilitary voters, but he said county election officials could decide whether their polling places would remain open over the weekend to accept in-person ballots from military and overseas voters.

The Obama for America campaign in July sued the state, arguing that treating military and nonmilitary voters differently violated the Equal Protection Clause of the Constitution. A federal trial court agreed with that argument and in August stopped the changes in Ohio’s early voting window from taking effect.

Ohio Attorney General Mike DeWine (R) and Husted asked the Sixth Circuit to reconsider the lower court’s decision to halt changes to the state’s early voting rules. They argued that Ohio’s law did not treat “similarly situated” individuals differently and that the Constitution does not prevent a state government from applying “different rules to those in demonstrably different circumstances.” Even if the law did, the state argued, the way the lower court chose to remedy the situation was overbroad.

“It would have sweeping ramifications for every State in this judicial circuit if the decision ... is sustained,” the state said in a court filing.

The appellate court did not agree with DeWine and Husted’s argument that the lower court ruling was overbroad because it mandated early voting hours during the three-day period before Election Day. The three-judge panel said the new rules were unconstitutional not because they stopped early voting but because they differentiated between military and nonmilitary voters. County boards could still make their own decisions regarding early voting during the disputed period.

“What the [judges] are saying is that we, the federal judiciary, aren’t insisting that you have these three days of early voting everywhere; we’re just insisting that you treat the military and nonmilitary voters the same. So if under Ohio law every county gets to decide what to do, they still get to decide as long as they treat military and nonmilitary voters the same,” said Edward Foley, an election law expert at Ohio State University.

Husted characterized the ruling as one that would create confusion as Ohio’s 88 counties establish their own rules leading up to the elections.

“That means that one county may close down voting for the final weekend while a neighboring county may remain open. How any court could consider this a remedy to an equal protection problem is stunning ... the last thing I want to see is a non-uniform system where voters will be treated differently in all 88 counties,” Husted’s statement said.

Legal experts dismissed the idea that Husted would need to lodge an appeal with the Supreme Court to ensure uniform early voting rules.

“He could insist on a statewide standard if he wants to,” Foley said.

“To the extent that there is any differential treatment between counties, Secretary Husted has no one to blame but himself for that and he has the power to fix it,” Tokaji said.

Husted acknowledged in his statement that “should the state not be successful upon appeal” he will begin consulting with all 88 counties to craft a directive to set hours for early voting.

A spokesman for Husted’s office said that “at the core,” the appeal is about “whether a state is going to run its elections or a federal court is going to do it.”

“Whatever the outcome is, voting hours will be uniform statewide” before Election Day, spokesman Matt McClellan said.

The U.S. Supreme Court could decide to reverse the appellate court’s ruling and allow the new rules to take effect before the 2012 elections. Justice Elena Kagan considers Sixth Circuit requests for emergency stays.

Legal experts told Roll Call that, in high-profile cases, her practice is to refer those requests to the full court.

Foley said he was “confident” the court would rule on the stay application before Election Day.

Ryan: Romney's Best Spokesman

The vice presidential debate gives Paul Ryan a unique opportunity to explain Mitt Romney's economic programs and ideas in front of a massive national audience.  We will see Paul Ryan at his best.  And that is very, very good.

He is not just a vice presidential candidate.  He is the author and intellectual founder of the modern Republican agenda.  There can be no more profound and articulate a spokesman to defend and elaborate the Romney agenda to America.

It is rare that the ideological and substantive creator of a public policy agenda gets to weigh in during a national public debate.  Usually, intellects of his scope and force are relegated to ghost writing and speech preparation.  But now the originator of these ideas is the candidate himself. His ideas have shaped the entire Republican agenda and his programs for reform have energized its ranks.  Now the author, himself, will be called upon to define and defend his programs and his ideas.

For his part, Joe Biden is a party hack called upon to defend an agenda which he did not design and of which he likely only partially approves.  Beyond the challenges he has in public speaking, Biden is not in Ryan's league when it comes to understanding issues and grasping the problems America faces.  The difference between a genius and a hack will be evident in Thursday's debate.    

Commentators and pundits have been fast to ask why Obama did so poorly in the first debate.  But they aren't asking the real question: What is the impact of Romney being so good?

The reason Romney did so well is that his positions are in line with those of the American people.  By making the election about big things like the size of government, the level of spending and the need for government regulation, Romney -- and now Ryan -- can showcase differences between the tickets that work decisively to the advantage of the Republican ticket.  And there is nobody better qualified or equipped to define and discuss these differences than Paul Ryan.

By focusing on policy -- as he always does -- Ryan can craft a national consensus that he and Romney are right and that Obama and Biden are wrong.  Without focusing on personalities, likeability, or charisma, Ryan can make Americans understand the alternatives and the stakes in this election.  The good he can do to the ticket is enormous.  He can cement Romney's victory in the first debate and make permanent the bond Romney established with the American people.

Lara Logan: Obama lying, al-Qaeda and Taliban stronger than ever

This was no ordinary rubber chicken affair. That was my reaction to the extraordinary keynoter at Tuesday’s Better Government Association annual luncheon. 
Lara Logan, a correspondent for CBS’ “60 Minutes,” delivered a provocative speech to about 1,100 influentials from government, politics, media, and the legal and corporate arenas. Such downtown gatherings are a regular on Chicago’s networking circuit. (I am a member of the BGA’s Civic Leadership Committee, and the Chicago Sun-Times was a sponsor).
Her ominous and frightening message was gleaned from years of covering our wars in the Middle East. She arrived in Chicago on the heels of her Sept. 30 report, “The Longest War.” It examined the Afghanistan conflict and exposed the perils that still confront America, 11 years after 9/11.
Eleven years later, “they” still hate us, now more than ever, Logan told the crowd. The Taliban and al-Qaida have not been vanquished, she added. They’re coming back.
“I chose this subject because, one, I can’t stand, that there is a major lie being propagated . . .” Logan declared in her native South African accent.
“There is this narrative coming out of Washington for the last two years,” Logan said. It is driven in part by “Taliban apologists,” who claim “they are just the poor moderate, gentler, kinder Taliban,” she added sarcastically. “It’s such nonsense!”
Logan stepped way out of the “objective,” journalistic role. The audience was riveted as she told of plowing through reams of documents, and interviewing John Allen, the top U.S. commander in Afghanistan; Afghan President Hamid Karzai, and a Taliban commander trained by al-Qaida. The Taliban and al-Qaida are teaming up and recruiting new terrorists to do us deadly harm, she reports.
She made a passionate case that our government is downplaying the strength of our enemies in Afghanistan and Pakistan, as a rationale of getting us out of the longest war. We have been lulled into believing that the perils are in the past: “You’re not listening to what the people who are fighting you say about this fight. In your arrogance, you think you write the script.”
Our enemies are writing the story, she suggests, and there’s no happy ending for us.
As a journalist, I was queasy. Reporters should tell the story, not be the story. As an American, I was frightened.
Logan even called for retribution for the recent terrorist killings of Christopher Stevens, the U.S. ambassador to Libya, and three other officials. The event is a harbinger of our vulnerability, she said. Logan hopes that America will “exact revenge and let the world know that the United States will not be attacked on its own soil. That its ambassadors will not be murdered, and that the United States will not stand by and do nothing about it.”...

”It is clear that the risk of conflict in the region is higher now than when the president took office” said Mitt Romney about Barack HUSSEIN Obama’s first term in office.

The man who promised that relations with Arab countries would improve if he was elected president back in 2008 has proven that promise to be yet another disaster on his watch.

With less than a month to go until the election, Barack HUSSEIN Obama is now laying out a desperate campaign strategy of painting Mitt Romney as a liar while Mitt Romney is staying focused on the important issues of the economy and foreign affairs, as he lets Obama be his own worst enemy.

Seizing the political momentum gained from his knockout of Obama at last week’s debate, Mitt Romney’s foreign policy speech yesterday was a focused and targeted assessment of the Obama initiated policies in the Middle East, especially of his failed Arab Spring which has set the region on fire.

Stressing the fact that the recent attacks are evidence that al-Qaeda remains strong, all while looking and sounding like another Ronald Reagan, Mitt Romney raised important questions about how this administration handled, or should I say mishandled, foreign policy, especially in light of last month’s attack in Benghazi that resulted in the murders of Ambassador Christopher Stevens, his Information Officer, and two ex-Navy SEALS.

"The attacks on America last month should not be seen as random acts," Romney said. "They are expressions of a larger struggle that is playing out across the broader Middle East, a region that is now in the midst of the most profound upheaval in a century.”

How right he is as country after country is falling into the hands of the Muslim Brotherhood, al-Qaeda, and a resurgent Taliban.

Not good...NOT good at all.

"I know the president hopes for a safer, freer and a more prosperous Middle East allied with the United States," Romney said. "I share this hope. But hope is not a strategy."

No it is not...never has been, never will be, for under the policies of Barack HUSSEIN Obama hope is nothing but an empty four-letter word.

“This president’s poor excuse of a strategy for the Middle East has been one of passivity and indifference,” Romney said, stating that he would be aggressive and dominant, including placing even tougher sanctions and more on Iran, and allowing for "no flexibility with Vladimir Putin" over missile defense.

As it should be for you NEVER stand down to your enemies nor give them flexibility in any matters of our national defense.

Romney promised his administration would garner “peace through strength” and that he would NEVER ‘lead from behind’ saying, "It is the responsibility of our president to use America's great power to shape history, not to lead from behind, leaving our destiny at the mercy of events. Unfortunately, that is exactly where we find ourselves in the Middle East under President Obama."

How right he is for leading from behind is NOT leading at all.  In fact, ‘leading from behind’ is an open invitation for the enemy to come get you, because instead of fighting the message has been sent that you will back down.  

So has been the case with Barack HUSSEIN Obama.

And as the response to Romney’s speech from ‘Team Obama’ starts coming in, all negative of course and saying that Romney’s speech lacked substance and nuance, foreign policy analyst Michael O’Hanlon of the Brookings Institution, praised Romney for ‘raising the profile of foreign policy issues’ and for creating a counterbalance to those wanting us to pull back from around the world.

“I like the tone of patience and engagement even if I may disagree on certain specific substantive matters,” O’Hanlon said on Fox News after Romney’s speech.  “What Governor Romney has done is make it easier to debate on both sides in terms of what are the next steps we need to take as Americans.”

This is exactly how Ronald Reagan won against Jimmy Carter...debating on substantive matters and standing strong for America by NEVER backing down or apologizing for American ideals and values, nor disparaging American exceptionslism.
