The 'Constitution-Free' zone is anything but constitutional

Ending the biggest assault by any administration on religious freedom, 'We the People' won two battles yesterday as the Supreme Court ruled in favor of both Hobby Lobby and that caretakers do NOT have to join or pay unions so they can take care of loved ones at home.

Two battles won but there are so many more to go before our beloved America is set right again, and one battle that looms large as it affects our welfare system, our healthcare system, and our economy is our unsealed southern border situation... especially in Texas.
 

Texas has become hell...literally...as Obama sits back and smiles because for him everything is about votes...future Democratic votes. We all know this is his true motive as he does NOT give a damn about these people per se only about what they can do for the party. And he knows they're willing to sell their souls by way of their votes so as NOT to bite the hand that feeds them. But there are things kept hidden by this administration that concerns NOT only those crossing our borders but how their doing so affects each and every one of us.

First, what's happening now is that America is being assaulted by an influx of ILLEGAL criminals...YES criminals...crossing our southern border. Called 'undocumented immigrants' by the media these folks...even the children...do NOT deserve that moniker because they're criminals by their very act of crossing into our country without following our immigration laws...meaning they've broken our laws to get here. And if you break our laws you're a criminal...as the meaning of the word criminal is that you've done something ILLEGAL.

However, doing something ILLEGAL is NOT just a catch-phrase for those crossing our borders, it also applies to the questionable activities of the Obama administration...and questionable includes keeping from public knowledge ILLEGALITIES done in reference to those crossing ILLEGALLY.

 

Now here's something few are aware of although it was mentioned fleetingly some years back on FOX...something regarding the extent to which the Obama administration monitors, collects information about us, and trashes our Constitution. It seems in 2009, the DHS...which is charged with securing our nation’s borders... announced it would conduct a 'Civil Liberties Impact Assessment' of its in-place 'suspicionless' search-and-seizure policy...and what's in place encompasses the entirety of the United States. Claiming it was done in the name of national security...the DHS made-up what's called the 'border zone'...a zone that stretch 100-miles inland from every coast and from our northern and southern borders, including where U.S. land meets oceans in addition to recognized borders with Mexico and Canada. Legally, the 100-mile border zone is called the 'extended border' of the U.S., as defined by Title 8 of the Federal Code of Regulations that deals with "Aliens and Nationality."

There's also something called the 'functional equivalent border,' which encompasses areas around international airports within the interior region of the U.S. And this spreading into the interior is part of a broad expansion of border powers with the potential to affect the lives of we ordinary Americans who have NEVER left the country let alone tried to enter it. So with that the DHS has now set themselves above the Constitution and done so by making, setting, and enforcing their own rules.

And get this...within the border zone the DHS can search your electronic belongings for NO reason whatsoever...and NO reason whatsoever is buried within their own DHS regulations as long as three criteria are met: first, a person must have recently crossed a border meaning if they're already here they become exempt; second, an agent should know that the object of a search hasn’t changed; and third that 'reasonable suspicion' of a criminal activity must exist...yet ignoring that crossing the border ILLEGALLY is a criminal activity in and of itself.

Bottom line...as a result of the DHS created 100-mile border zone, there are now almost 200 million people living within this zone, including those in New York City, Houston, Los Angeles, and Philadelphia. In addition, the DHS made it so that they can ‘overrule’ the Fourth Amendment...which mandates that a search or seizure done by a government agent must be ‘reasonable’...NO matter that the courts have construed Fourth Amendment 'reasonableness' as requiring probable cause and a judicially granted warrant. And the DHS can now also ‘overrule’ the First and Second Amendments within that 100-mile border zone, initiating what amounts to a Constitutional crisis for the Supreme Court has recognized several exceptions to certain Constitutional amendments, one of which is the border search exception within said zone.

Oh really... 

 

Enter center stage the ubber liberal American Civil Liberties Union (ACLU) who surprise of all surprises honored the rule of the law...the law as laid down in the Constitution...saying that any regulation allowing customs and immigration agents to search electronic devices at America’s borders without 'just cause' was, is, and will always remain wrong. And least people forget, two years earlier the ACLU tried to warn us that the 100-mile border...dubbed by the DHS as a 'Constitution-Free' zone'...was going to be put in place. But did we listen...NO we did NOT as the media...except for the brief mention on FOX...hushed it up for obvious reasons.

And of course the DHS then countered the ACLU by saying that according to legal precedence... District Judge Edward Korman's upholding of the Obama administration policy granting officials the authority to search American's laptops and other electronics including cell phones...citing a controversial premise that makes citizens within 100 miles of the border eligible for a police check...basically meaning that the Fourth Amendment does not apply along the border zone. Saying that customs and immigration agents can “exercise long-standing constitutional and statutory authority permitting suspicionless and warrantless searches of merchandise at the border and its functional equivalent,” the DHS grossly overstepped their bounds as far as 'We the People' are concerned.

So as we come full circle at the borders...militia groups are now gathering at the border to do the job border agents can't do or simply won't do...can't do because they're overwhelmed by the numbers of people crossing the border...or won't do as they know they can't stop the influx of ILLEGALS entering our country because our president does NOTHING to stop them...instead encouraging more to come.

And as for the ILLEGALS...especially in regards to the children being shipped to areas within the 'Constitution-Free' zone...within the100-mile border zone...they cannot be touched...meaning they cannot be deported as this exception from searches and deportation was made part of the 'Immigration and Nationality Act.' So ILLEGALS get protection from being searched and/or deported but 'We the People' get NO such protection.

And so it seems U.S. laws are NOT in effect in the 'Constitution-Free' zone...NOT the First, Second, or Fourth Amendments. And with the Border Patrol NOT doing what they're supposed to do...what their job dictates they do...as in detect and prevent ILLEGAL aliens, terrorists, and terrorist weapons from entering the U.S., along with preventing ILLEGAL trafficking of people and contraband. But trafficking is exactly what the Obama administration does when shipping ILLEGAL children off to Arizona...and our border agents can't do a damn thing as they've been delegated to changing the diapers of these ILLEGAL criminal children swarming our borders.

So as more of our civil liberties erode away...especially if you live in a border state within the 100-mile zone...you have more to fear from your government than those entering our country ILLEGALLY...and sadly that's how it is in today's America.

Three issues NOT to be forgotten come mid-term election day

ObamaCare, the NSA, Benghazi...it does get tiring hearing about them after awhile I know, but these issues must remain in the forefront as we head into the mid-term elections, for these issues are just the things that might turn Congress around...painting it RED in both Houses.

These issues...scandals some call them...MUST be talked about every chance we get because they go to the very core of what's wrong with the Obama administration and they all have one thing in common...LIES.  But sadly, in the case of Benghazi four Americans who did NOT have to die...did die...and one of them, Ambassador Christopher Stevens...died from unspeakable torture all because of Barack HUSSEIN Obama's LIES.

First issue, ObamaCare...the gift that keeps on giving...a gift from hell we can all do without as ObamaCare's very concept was based on the LIE that Barack HUSSEIN Obama wanted to provide 'affordable' health insurance to those Americans who were without health insurance.  But as we sadly found out, millions who had health insurance lost said insurance simply because what their policies stipulated did NOT meet what the 'anointed one' deemed to be what they must have. 

 
And the words spewed that 'we could keep our insurance if we liked our insurance' was NO misspeak (as the alphabet tries to claim in their covering-up for Obama) as keeping our insurance would be counter to the very premise of ObamaCare ...as in screw the middle class because if the 'sponges' are taken care of they'll stay loyal to the party...as in the all important votes.  Losing our insurance was critical if ObamaCare was to work, because it needed those privately insurance to be forced out of their plans and onto the exchanges, as their money would make up for the older, less healthy people who would flood the exchanges.  

And remember, the very idea of there being millions of uninsured Americans is a misnomer in and of itself as the so-called 'uninsured'...whether LEGAL or ILLEGAL...can walk into any emergency room in this country and get treated.  And what they're being treated for does NOT have to be what we normally think constitutes an emergency for many use the emergency room as their 'doctor' per se, and they are NOT turned away. They might have to wait for hours but they do get seen and they pay little or NOTHING for said treatment...and it's we taxpayers who pick up their tab.

And if truth be told there was a simple solution if insurance coverage was what Obama really wanted to replace expensive to reimburse emergency room visits and to actually insure the uninsured.  All that had to be done was to set up a special plan for those people who had NO insurance without touching what was in place for those who did.  A program similar to what Florida did to cover those who lost their insurance when major companies pulled out of the state after Hurricanes Andrew and Wilma could have been followed.  Those uninsured folks were taken into the state run plan (Citizens Insurance) and were offered coverage they could afford for what they wanted covered...simple concept that could easily be tweaked to apply to health insurance.

But when insuring people fairly was NEVER the plan to begin with, what you get is ObamaCare ...an anything but affordable LIE...set up to fail from the start so Obama could get what he always wanted...a single-payer health care system where we would all be beholden to the government for our medical needs... including being told when it's time for us to die.

Remember ObamaCare come mid-term election day.

And this leads to issue two...the NSA spying on 'We the People.'  Obama's claiming this is for our safety and protection...for national security...is an outright LIE as it's NOT we everyday Americans who pose a threat to our national security...it's Obama's muslim brethren who do...period. 

And all the data mining done on 'We the People'...whether through garnering our phone calls, e-mails, or text messages...was done in violation of our Fourth Amendment rights.  And just like all the groping done by the TSA on we Americans has resulted in NO terrorists trying to board our planes, the same goes for all the NSA spying because 'We the People' are NOT the terrorists.  So all this 'political correctness' nonsense done just so NOT to step on muslim toes...toes that make up only 2% of our population...needs to stop for the simple fact is that 98% of all terrorist acts committed here in America and worldwide are done by muslims...a fact Obama knows damn well...a fact he deliberately chooses to ignore for muslim blood courses through his veins. 

And if Obama really wanted to keep us safe...which it seems he doesn't...there really is a simple way to do it...bring back racial profiling.  YES...racial profiling for if one is innocent one has NOTHING to hide or fear even if they are profiled.  But the bleeding heart liberals and the likes of the ACLU would rather protect the rights of the guilty than protect the rights of the innocent to be safe from the guilty.

The NSA does have a purpose but when they overstep their bounds...when they knowingly violate the Constitutional rights of the American people by doing the bidding of a man whose loyalties lie with Americas enemies...they must be called to task just as the man who ordered them to do what they do must be, for what they're doing is based upon a LIE of who does and who does NOT pose a danger to our country.

And the third issue...Benghazi.  Benghazi...NO mere words I say can convey the horrors four brave Americans faced as this most miserable of presidents watched them being slaughtered in real-time and then bold-faced LIED over and over as to why they died.  We all know the rhetoric by now about a YouTube video being the cause....knowing it was a LIE from the moment those words spewed from the mouth of the man who (I believe) was indirectly complicit in their deaths...by the only man who could have issued the 'stand down' order NOT to have any of our troops go in to try and rescue them...and them make up excuses and LIES about there being NO time to do so.

Barack HUSSEIN Obama and his cohort in crime, Hillary 'What Does It Matter' Clinton, must answer for Benghazi...the crime of all crimes for Benghazi runs the gamut of gun running to the enemy, murder, cover-ups, LIES, and treason...and must be called to task and forced to speak the truth about what happened that fateful night...and then they can be led off in handcuffs to GITMO...the prison Obama turned into a country club for muslim terrorists and their sympathizers...as they'll both feel right at home there.

Barack HUSSEIN Obama is rendered politically impotent on that day by us turning Congress red...can he do NO more harm to our beloved America, to 'We the People', and to our troops fighting to keep us safe and free at home.  And only than can the ghosts of Christopher Stevens, Sean Smith, Tyrone Woods, and Glen Doherty forever Rest in Peace.

So while I know some are tired of hearing about ObamaCare, the NSA, and Benghazi we cannot allow these most important of issues to fade from the public consciousness, because if we do complacency will once again set in, and if you think 2012 was a nightmare 2014 could very well signal the end of the United States of America as we know, love, and honor her.

The NSA Scandal…Obama tried to make it go away...he failed

OK folks…I’ll begin at the end…Barack HUSSEIN Obama saying “God Bless America” twice at the end of yesterday’s press conference just turned my stomach because you could see him choking on those words while trying to get them out…good thing they were on the teleprompter or I doubt they would have come out at all, but back to the beginning.

Yesterday, after a six-month White House ‘supposed’ investigation into whistleblower Edward Snowden’s flood of disclosures about the true scope of U.S. spying, President Obama (gag) held a press conference to discuss the changes he will implement in how the NSA collects and stores data on ‘We the People,’ our allies, and our enemies.

Saying that the NSA officials did NOT “intentionally abuse” the program to invade our privacy…yeah right…Obama went on to say that he believed opponents of the program had been correct in saying that without proper safeguards the data collection could be used to garner even more personal information about the private lives of Americans then they already had, and that it could open the door to even more intrusive programs.  Nice words but the thing is Barack HUSSEIN Obama was the very man who ordered the NSA to 'spy' on American citizens and will continue to order them do so.

And critical to all he said…actually to what he did NOT say (taqiyya in action)…is that in NO way will the invasion of our privacy be stopped… translating into the information will still be collected just NOT as much of it…at least that we can see that is. 

Also, Obama said that ‘some’ of the changes he intends to make will take effect immediately, but that ‘other’ changes will require further study…which means more of our taxpayer dollars will be wasted on a study of a program that clearly violates our 4th Amendment rights…and that those changes may take an action of Congress to be implemented.  Uh oh…this sitting Congress does NOTHING as it is so I guess that means that in regards to spying on ‘We the People’ they will do even less than NOTHING.

"The reforms I am proposing today should give the American people greater confidence that their rights are being protected, even as our intelligence and law enforcement agencies maintain the tools they need to make us safe,” Obama said during the press conference.

Greater confidence in an administration that shoved the ObamaCare monstrosity down our throats, still covers-up ‘Fast & Furious and does even worse in regards to Benghazi…NO...I don’t think we have any confidence at all in anything this most miserable of presidents proposes.

So folks here now is just a bit of what Obama proposed…and just this bit alone should have you hopping mad.  First off, effective immediately, the NSA will be required to get a ‘secretive' court’s (actually the Foreign Surveillance Intelligence Court) permission before accessing phone records and data that will still be collected from millions of law-abiding Americans…but I say why NOT an ‘open court’ of public record...why a ‘secretive court’…what’s he still trying to hide…hmmmmm…

And Obama said that those phone records...which includes numbers dialed and length but NOT content of calls...will NO longer be stored by the government itself but either by a third party or by the phone providers themselves. Oh really…and what of the huge data mining storage center that he had built in Bluffdale Utah…who now will be the keeper of the phone records when a  ‘For Sale’ sign gets tacked to its front door.  And with the phone companies opposing the expense and potential liability of holding said data, and with NO ‘credible’ third party yet to come forward, you can rest assured that if a third party does takes over they will be one hand-picked from his many campaign donors so that all Obama has to do when he wants to do his snooping is just mossy on over to that third party and say, ‘let me see’…just a slight detour in his targeted control of ‘We the People.’

And this little goody…which al-Qaeda operatives and other assorted terrorists will love…borders on the outright dangerous when it comes to the monitoring of true terrorist activity (the only activity that actually should be monitored), as Obama has said that the government will NO longer be allowed to access phone records beyond two so-called ‘hops’ from the person they are targeting... meaning NO access to phone records for someone who called someone, who called someone, who called the suspect, will be allowed…. NOTHING like helping the brethren yet again.

  Also saying that the U.S. won’t monitor the communications of “our close friends and allies overseas” unless there’s a ‘compelling’ national security reason is pure hogwash as Obama is NOT releasing a list of which countries fall under that category…and Obama being what he is with America’s allies being his enemies and America’s enemies being his allies, heaven only knows where he’s going with this one…or should I say hell only knows to be more exact.

And Obama stating that he will be issuing a ‘presidential directive’ (an order that has the same legal standing as an executive order that remains in effect until a change in administration deems otherwise),that will state the government can only use collected phone data for counterintelligence, counterterrorism and cyber-security to protect U.S. forces and allies, and to "combat weapons proliferation and transnational crime” is again even more hogwash as first, we cannot believe a single word coming out of his proven to be lying mouth ("If you like your current health insurance policy you can keep it…period”) and second, everyday Americans like you and me are NOT involved in spying, terrorism, cyber-hacking, weapons trading, or international crime and Obama and his NSA buddies know it as well as we know that it’s ‘We the People’ who will still be the ones spied on.

And proof is that Obama wants to give foreigners protections against spying and is directing the Director of National Intelligence and his ‘good bud’ AG Eric ‘Fast & Furious’ Holder to put in place safeguards as to how long the U.S. can hold information on non-citizens overseas, and restrictions on how the data is used.  This he does for non-Americans while ‘We the People’ continue to get the proverbial shaft…and again continue to be spied on.

But NO matter what changes Obama says he will make but NOT really do, the bottom line remains that Barack HUSSEIN Obama stands by and completely supports the NSA’s spying on ‘We the People.’  By calling said spying "necessary for national security” he continues to look away at what he called ‘the foreigners’ in our country…meaning his muslim brethren…who are the only real terrorists this program needs to keep track on. And being that he left all the final decisions primarily to Eric Holder's anything but Justice Department and to intelligence agencies that oppose making any changes to the current surveillance operations at all, you just know this entire matter will soon be swept under the rug...or at least that is what Obama will try to do.  Maybe this time Congress will make sure it's NOT but I'm NOT going to hold my breath for that.

Oh and by the way, Obama's shiny and sweating face...that you can see got shinier, sweatier, and pastier as time went on...is a dead give-away that even he knows all his talk was NOTHING but empty political bloviatings...smoke and mirrors if you will...as he tried to get our attention focused off ObamaCare and Benghazi...and to that I say he failed miserably.

A hero NOT quite but a traitor NOT

Obama is mad…furious is more like it…as the scandals plaguing his administration just keep coming but one in particular has ramifications for us all…for this president has, to put it bluntly, been spying on ‘We the People’.

Unbeknownst to the American public, under the banner of a program called PRISM, the National Security Agency (NSA) has had access to all our customer data logs, meaning all telephone calls we make and all e-mails we send, with the information being given to them by major (left leaning) internet companies that we all use, including Google, Yahoo, Microsoft, Apple, and Skype…in other words BIG Brother is indeed watching us…and his name is Barack HUSSEIN Obama.

And this is tantamount to violating our Fourth Amendment rights, “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized”.

And that is at the heart of these recent events.

Enter center stage Edward Snowden, a former NSA contractor who just a few short weeks ago leaked information about this secretive surveillance program (including newly released leaks that NSA analysts can access the contents of a ‘target’s’ phone calls and e-mails without a court order), and true to form for crossing and angering ‘the anointed one’ Snowden has now been formally charged as Federal prosecutors filed a criminal complaint of espionage against him, which included theft, ‘unauthorized communication of national defense information’ and ‘willful communication of classified communications intelligence information to an unauthorized person’, as well as asking Hong Kong (where Snowden is suspected of still being) to detain him on a provisional arrest warrant.

The last two charges against Snowden were brought under the 1917 Espionage Act of which this White House is responsible for bringing six of the nine total indictments brought since the Act went into effect (and there have only been fourteen convictions for treason in the entire history of our country). But is Snowden actually guilty of espionage or treason as some claim, or is he really a hero for alerting the American people to yet more wrong doings by this administration…and that question will most likely decide his fate if he ever is brought back to or returns on his own to the United States.

And while Obama and those in his administration continue to defended PRISM and other programs in the same genre, claiming many terrorist plots have been thwarted because of them, that still does NOT give him or anyone else the right, whether it’s technically legal or NOT to spy on we law abiding citizens for there are some things that are NOT only unconstitutional but just plain morally wrong and this is one of them…but then again morals is something so lacking from this entire administration.

Now according to our Constitution treason, the only crime actually defined in the Constitution, is spoken of in Article III, Section 3: “Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attained.”

So is what Snowden did treason via espionage…NO I don’t think so as he has NOT levied war against the US, given aid and comfort to the enemy, nor does what he did pose an immediate or tangible danger to this country. In fact, what he did was quite the opposite as he alerted the American people to the immediate and tangible danger we are in at the hands of our own government and from our own president.

Also, the crime of treason requires a traitorous intent, which again he had NO intent for what Snowden did was ‘whistleblow’ on his corrupt employers and alert the public to acts perpetrated by those in power against ‘We the People’… that makes what he did a classic example of the definition of a whistleblower. And what really is a whistleblower but an informant who exposes wrongdoing within an organization in the hope of stopping it…and that is what Snowden did by going public with the information he had.

Now here’s the dilemma…in order to expose this contemptuous act by this administration Snowden had to ‘take’ the proof…steal it if you will…and stealing is indeed a punishable crime as is releasing confidential information he, when hired, agreed NEVER to do. But in a case such as this where the American public is actually the victims of a crime perpetrated on them by their own government…by their own president…does that excuse what he did, because what he did was for the common good.

And how are whistleblowers going to be able to prove their accusations unless they have real tangible in-hand documents to back up what they claim unless they ‘take’ them, because no one is going to voluntarily give them the documents needed.

And now with Snowden being both condemned as a traitor and lauded as a champion of ‘We the People’s’ right to privacy, the fact remains that America is still at war, and while we can criticize our government during a time of war, unless one adheres to the enemy one is NOT a traitor. And NOTHING Snowden did adheres him to any of our enemies for Snowden is being accused of ‘possibly’ passing information to China, and we are NOT at war with China for a state of war actually has to be levied against a country before there can be charges of treason made against anyone, and NO state of war has been levied by this country against China, hence NO adhering has been done to an enemy.

And anyway, to date there is NO proof Snowden has given China or any other nation classified information of any kind…just supposition put out by the media in an attempt to cover for and dilute the crime this president and his administration have committed by spying on the American people…done and gotten caught doing to be more exact. And let’s NOT forget how can Snowden be guilty of treason or espionage, let alone any crime, when both the NSA and Obama continue to claim they are NOT spying on us.

The bottom line in all this is that the right thing will always be that if our government is doing something illegal we have a duty to report it…and that is what Edward Snowden did when all is taken into account (albeit by breaking the law and stealing what wasn’t his), for what he did was expose serious Fourth Amendment violations knowingly and willing done by our government against the American people.

But because he broke the law to do what he did Edward Snowden might NOT be a hero per se, but he sure as hell is NOT a traitor…that distinction goes to our ‘aiding and abetting’ traitor of a president Barack HUSSEIN Obama.
