When liberal pro-Obama scholars question the legality of President Barack Obama's actions to implement Obamacare, the issue of illegal presidential use of power moves from partisan to frightening.

George Washington Law School's Jonathan Turley is the second most quoted law professor in the nation and a two-time Obama voter. He recently testified before Congress on Obama's extensive use of executive orders and administrative actions to make unilateral changes in Obamacare, immigration policy, minimum wage and the IRS qualifying standards for non-profit status.

As to Obamacare, Obama, so far, changed it in at least a dozen major ways, including, but not limited to, postponing the employer mandate, allowing insurance carriers to let their insured keep an old policy, and, more recently, redefining the Obamacare "hardship" exemption so broadly as to nullify the individual mandate for at least two more years.

Was this legal?

Turley said: "President Obama has repeatedly violated this (separation of powers) doctrine in the circumvention of Congress in areas ranging from health care to immigration law to environmental law. We are in the midst of a constitutional crisis with sweeping implications for our system of government. ... " We are now at the constitutional tipping point for our system."

Turley challenged Congress to re-assert its authority. "If balance is to be reestablished," he said, "it must begin before this President leaves office, and that will likely require every possible means to reassert legislative authority. No one in our system can 'go it alone' -- not Congress, not the courts, and not the President."

Obama sold Obamacare with many now-broken promises. Saving costs was a big one. In 2009, the Congressional Budget Office set the net cost of Obamacare at $599 billion over 10 years -- citing a gross cost of $848 billion less $249 billion in tax revenues and other cost savings. But recently the CBO revised the 10-year price tag to more than $2 trillion.

Economist Jonathan Gruber, the father of Romneycare -- which was the template for Obamacare -- recently admitted that well, no, costs will not be going down. "Covering people with health insurance doesn't save money," said Gruber. "That was sometimes a misleading motivator for the Affordable Care Act. The law isn't designed to save money. It's designed to improve health, and that's going to cost money."

So, Obamacare won't save money, but at least those too poor to afford health insurance will now lead healthier lives, right? Not necessarily.

Oregon expanded its Medicaid program years ago -- the way Obamacare does now -- to include some of Oregon's low-income uninsured. Because of costs, Oregon did this on a random lottery basis.

Some got it, some, unfortunately, wanted to but couldn't. But this allows comparisons. Oregon, for example, can now compare the health outcomes of the now-insured Oregonians against those who wanted to get insurance, but couldn't. Surely, the now-insured are healthier compared to those without health insurance.

But there were no significant differences in their health care outcomes. While the newly insured did increase their doctor visits for preventative and primary-care services, some could not get appointments with doctors, many of whom wouldn't take new Medicaid patients. Emergency room use went up 40 percent among the new Medicaid patients, not down -- all for non-emergency medical needs. Forbes health care researcher Avik Roy writes, "The result calls into question the $450 billion a year we spend on Medicaid, and the fact that Obamacare throws 11 million more Americans into this broken program."

Worse, the uninsured dislike Obamacare even more than do those with health insurance. A recent Kaiser Health poll found that among the uninsured, only 22 percent have a favorable attitude toward Obamacare, a far-lower percentage than the 56 percent of uninsured who are unfavorable toward Obamacare.

Before Obama became president, he said if he were "starting from scratch," he'd go with a single-payer system. A few months ago, Democratic Senate leader Harry Reid was asked whether Obamacare would lead us to single-payer. Reid said, "Absolutely." This is the real plan.

Single-payer is universal healthcare system used in Canada. It remains popular. But in 2009, the incoming president of the Canadian Medical Association said: "(Canadian doctors) all agree that the system is imploding. We all agree that things are more precarious than perhaps Canadians realize."

What did the outgoing CMA president propose? He said: "A health care revolution has passed us by" and "competition should be welcomed, not feared." So while the Canadian Medical Association urges more competition and privatization, America moves toward even more government involvement in health care.

In the annual index of countries rated on "economic freedom," the United States -- since 2008 -- has slipped from the No. 5 position to No. 12. Canada -- at No. 6 -- is now more "economically free" than the United States! Economic freedom and prosperity go hand in hand.

Yet this administration makes it clear it is more interested in wealth re-distribution and less interested in wealth creation. President Obama is quite adept at the former -- clueless about how to achieve the latter.
It was just gag gift. A joke.

That Nobel Peace prize that the Norwegians, on behalf of the Swedes gave Barack Obama.

I always found it ironic that the guy who was a major weapons manufacturer and inventor of dynamite would put up a prize for peace to begin with. But at least he tried to make amends for being known as a merchant of death.

Not so with Barack Obama.

As wars break out all over the world, our weakest man is stuck saying what he always says: “Who? Me?”

This is the same man who so quickly returned the Churchill bust standing in the Oval Office to the British Embassy that it offended some Englishman and some Americans.

Obama could have learned something from Churchill’s life. Or Nobel’s.

Churchill, half-American, most decidedly was a man of war and an imperialist, yet he knew more about making peace before he was 40 years old than Barack Obama will ever know.

Churchill fought Pashtuns in Afghanistan, dervishes in Omdurman and Boers in Pretoria. Yet he made peace with South Africa and with the “terrorists” in the IRA—at least most of them— to create the Republic of Ireland. He also negotiated peaceful relations with a communist Russia, a country that he called a blood stained bear.

He negotiated with striking transport workers and coal miners and was always willing to sacrifice everything short of honor for peace and goodwill.

That’s because Churchill was a strong man, comfortable in his strength.

And people who negotiate from their strongest positions are always in the best position to ensure peace.

And that stands in stark contrast to our weakest president, Barack Obama.

For all of Obama electoral success—the only resume item worth bragging about-- one might remember that U.S. Grant also was rewarded with two terms as president.

Grant, like Churchill, was a man of war, but not a strong man outside of the battlefield. The presidency for him was a gift from a grateful nation that wanted to believe that war meant something besides killing.

Obama could learn something from Grant’s life too.

“Ulysses Grant in his throw-away lines—in his throw-away life—kept trying to get people to see the colossal sick joke,” writes biographer William McFeely. “All you do is take the nicest guy on the block—the one who won’t be diverted by the dreams of vainglory or revenge or the sense of masochism—and knowing he is not good for much else, let him act on the bald fact that war means killing the guy on the other side, or at least scaring him badly enough that he will quit fighting.”

Grant alternately spent his life basking in the adulation of crowds or apologizing to himself for finding his calling in war.

Like Nobel, he tried to make amends.

He is remembered today, like Churchill, as a great man.

Obama, however, has no throw-away lines.

He does have Grant’s throw-away life.

That’s because Obama can’t see his own colossal sick joke: He was bestowed the presidency not because of the ascendancy of his ideas, but because of ascendancy of his race. And his race is political device, not a moral one.

The presidency, for Americans, has been a gift from a repentant nation, still ignoring the wrongs that took a great civil war to even begin to acknowledge.

And mixed amongst the national psyche, now merged with Barack Obama’s ego, is vainglory, revenge and masochism.

Alfred Nobel was a noble man and a smart one.

Winston Churchill was a strong man and just one.

Ulysses Grant was a determined man who tried to make himself a good man and succeeded.

Each understood that while peace is the ideal condition, there are worse things than war, real war.

Each was known for war, but their most lasting legacy was one of peace.

Obama understands none of it. He learns nothing from life that he doesn’t already know.

And that’s why he’s the only guy who still doesn’t get the colossal sick joke.

He got a prize though.

But the joke’s still on him: These days, everyone gets a prize.

Obama’s Internet Surrender: a “fate worse than death” for the Internet

The Obama administration has now endangered that hallmark of Internet freedom.

Obama’s next offensive in his war on freedom.

Global governance of the internet. “Global governance?” As in the UN? And who and what drives the UN? The largest world body drives the UN. Bat Ye’or describes the OIC this way, “The OIC is one of the largest intergovernmental organizations in the world. It encompasses 56 Muslim states plus the Palestinian Authority. Spread over four continents, it claims to speak in the name of the ummah (the universal Muslim community), which numbers about 1.3 billion. The OIC’s mission is to unite all Muslims worldwide by rooting them in the Koran and the Sunnah — the core of traditional Islamic civilization and values. It aims at strengthening solidarity and cooperation among all its members, in order to protect the interests of Muslims everywhere and to galvanize the ummah into a unified body.”

The Organization of the Islamic Conference will undoubtedly demand the suppression of websites that “insult Islam” or “encourage hatred,” and they won’t be referring to jihad forums that foment and incites to slaughter.

Atlas readers are well aware  of the goals of the Organization of the Islamic Cooperation. The OIC has already gotten passed a proposal in the UN, backed by Muslim nations, urging the passage of laws around the world protecting religion from criticism. Islam is the only religion specifically named as deserving protection.

Websites like mine are the ones that dare speak of the truth of Islam and report on the jihad and the terrible human rights abuses, the Christian, Jewish, Buddhist, Hindu etc. persecution, the suppression of women and children, the murder of non-believers, the brutal imposition of shariah law, Islamic supremacism, academic jihad, social jihad, cultural jihad, shariah finance, stealth jihad and the galloping global jihad. The corrupt media are already subdued and self-censor themselves. The net is all there is.

Back in 2009, Obama threatened such anti-freedom action; I blogged on this. He backed off after the American people and the Congress protested.
There have been no serious complaints about American stewardship of the Internet, no actual abuses perpetrated by American overseers. 
But were we to abdicate this stewardship, a number of difficulties could arise.
Domain names sometimes present political questions. Which side in a civil war should control Pakistan’s Internet domain? Should Israel’s .il be suspended as punishment for its being an “Apartheid state”? What about Taiwan’s .tw if China announces an attempt to “reabsorb its wayward province”?
Perhaps most serious, control of Internet names could become a lever to impose restrictions on Internet content. Many governments already attempt to control speech on the Internet. Some years ago, Yahoo! was subject to criminal proceedings in France for allowing Nazi memorabilia to be auctioned on its website. Britain, Canada, and Australia all have mandatory nationwide blacklists of banned sites, managed by nongovernmental regulators with minimal political oversight.
Such blacklists can have unpredictable consequences: Wikipedia was badly degraded to British users for some hours because of a poorly designed censorship system targeting child pornography.
If we give control of the Internet naming infrastructure to an international organization, we must expect attempts to censor the Internet. The Organization of the Islamic Conference will doubtless demand the suppression of websites that “insult Islam” or “encourage hatred,” and a number of European countries may well go along. 
Most countries lack our First Amendment tradition, and if we wish to protect the free speech rights of Americans online, we should not allow Internet domain names to be hostage to foreign standards. Many other First World countries already have government-imposed restrictions on Internet speech that we would not contemplate here.
Even if Internet governance were shared only with First World democracies, they might urge and ultimately demand that domain operators impose restrictions on content.
And now Obama has done it. He had no right but the tin pot-head has gone and done it.

Missing Malaysian plane: Files were deleted from pilot’s flight simulator

Ibrahim helped establish the International Institute for Islamic Thought, or IIIT, a Muslim Brotherhood front group in the United States. IIIT has come under fire for their connections with terrorist organizations. In 2002, Anwar Ibrahim’s IIIT was included in a lawsuit by victims of 9/11 seeking damages from organizations linked to ‘rendering material support to radical Islamism.’ In 2003, US government prosecutors ‘submitted court documents detailing financial support (PDF) from the IIIT for convicted Palestinian Islamic Jihad fundraiser Sami al-Arian.’ They also found that Taha Jaber al-Alwani, the president of IIIT had once stated via a fatwa that ‘jihad is the only way to liberate Palestine.’ A US Customs official said that the government is also looking into the possibility that IIIT was involved in ‘terrorism-related money laundering activities.’”

“Malaysia: Files were deleted from flight simulator,” by Ian Mader for the Associated Press, March 19:
KUALA LUMPUR, Malaysia (AP) — Investigators are trying to restore files deleted last month from the home flight simulator of the pilot aboard the missing Malaysian plane to see if they shed any light on the disappearance, Malaysia’s defense minister said Wednesday.
Hishammuddin Hussein told a news conference that the pilot, Capt. Zaharie Ahmad Shah, is considered innocent until proven guilty of any wrongdoing, and that members of his family are cooperating in the investigation. Files containing records of simulations carried out on the program were deleted Feb. 3, Malaysian police chief Khalid Abu said.
It was not immediately clear whether investigators thought that deleting the files was unusual. They will want to check those files for any signs of unusual flight paths that could help explain where the missing plane went.
Malaysia Airlines Flight 370 with 239 people aboard disappeared March 8 on a night flight from Kuala Lumpur to Beijing. Malaysian authorities have not ruled out any possible explanations, but have said the evidence so far suggests the flight was deliberately turned back across Malaysia to the Strait of Malacca, with its communications systems disabled. They are unsure what happened next and why.
Investigators have identified two giant arcs of territory spanning the possible positions of the plane about 7½ hours after takeoff, based on its last faint signal to a satellite — an hourly “handshake” signal that continues even when communications are switched off.
The arcs stretch up as far as Kazakhstan in central Asia and down deep into the southern Indian Ocean.
Police are considering the possibility of hijacking, sabotage, terrorism or issues related to the mental health of the pilots or anyone else on board, and have asked for background checks from abroad on all foreign passengers.
Hishammuddin said such checks have been received for all the foreigners except those from Ukraine and Russia — which account for three passengers. “So far, no information of significance on any passengers has been found,” Hishammuddin said….
Which contradicts previous published reports, but this whole affair is enveloped in confusion.

One of the many ugly truths about ObamaCare

A few weeks ago I told you about a dear friend of mine who has glioblastoma...brain cancer.

Yesterday I was with her when her doctor give her the horrific news that she has two to six weeks left of life...probably closer to two. 

So because of the 12-week bureaucratic delay in getting her insurance company to approve further treatment...paperwork delays that are the hallmark of ObamaCare ...her brain tumor had time to grow much larger and in fact to multiply, in addition to sending 'feelers' deep into her brain. There is NO hope, NO cure, and NO miracles as her brain... the very essence of who she being 'eaten up' as it necroses. And again, thanks to ObamaCare, there is NO true quality of life for her remaining days but I, and another good friend, will be by my dear friend's side helping her husband make her passage 'home' as peaceful and painless as humanly possible.
And something every single person in this country needs to know, as many are facing serious illnesses that will need Hospice in the end, is that thanks to ObamaCare certain insurance companies participating in the exchanges...even if the dying person holds those company's policies privately... will only provide 15-days of round-the-clock end of life nursing care. This means that if God forbid you cannot get an extension, your loved one will be left on the own with NO one to help with specialized professional end-stage palliative care.

And as we all know NOTHING in this life is written in stone for what is expected to be two weeks of life could stretch out to four weeks...and then what. So to Barack HUSSEIN Obama, 'Prince' Harry Reid, Nancy Pelosi, and all their Congressional ilk...especially the idiot Democrats who voted for this monstrosity before they even read it...and back to Harry Reid again who said these cancer horror stories were made up lies...I hope you all rot in hell...period.
