Bowe Bergdahl...An American Traitor

of the 25th Infantry Division stationed in Alaska, on his
then upcoming deployment to Afghanistan
He arrived at his court martial hearing before Military Judge Col. Jeffery R
Nance, regaled in 'dress blues'...a disgrace to the uniform...a
disgrace to his country...and by now we all know his story well...a
story that began on the night of June 30, 2009, when then Private
First Class Bowe Bergdahl simply disappeared from his patrol base in
northern Afghanistan. Captured by the Taliban, Bergdahl was held
captive for five years before Barack HUSSEIN Obama traded five
Taliban commanders for this one man. Was Bergdahl tortured as he
claims and did he try to escape 12 times...some say yes while others
say no...but that is not the crux of the issue nor should it mitigate
the seriousness of the charges now before him...charges that could
see Bergdahl facing up to life in prison.
And with public discourse, banter, and outrage rightfully raising questions as to this man's allegiances and loyalties; a
past president's illegal negotiations with the enemy; about our
country's commitment never to leave any American troop behind; and
about what is just punishment for this, I believe, American
traitor...the one thing we must insist on is answers to both why a charge
of treason was not levied against him and why the death penalty is not on the
table.
Focusing on the fact that Bergdahl walked off his post
without authorization thus shirking his assigned duties...a coward by
the accounts of most who served with him and a man who they say
"liked
to spend a bit too much time with the nearby Afghan
villagers"...Bergdahl's actions led directly to the deaths of six of
his fellow soldiers*...some husbands, some fathers, some sons, some
brothers...six soldiers killed by the enemy while searching for this traitor
during a time of war...a
“wrongfully caused” search and
recovery mission doomed from the start because the man they were
searching for did not want to be found. More on that in a bit.
“
I don't understand why we're trading prisoners at Gitmo for
somebody who deserted during a time of war, which is an act of
treason," said former Sgt.
Matt Vierkant, a member of Bergdahl's platoon on hearing that
Bergdahl had been trading for the five Taliban commanders, especially
since Obama was pursuing a “negotiated peace”
with the Taliban not the needed military victory in Afghanistan.
And so Bowe Bergdahl became the recipient of what Obama called
a
"confidence-building measure"...never mind
that it was an illegal action taken without his consulting
Congress...never mind that Obama turned his back on America by
negotiated with the enemy...never mind that it was a lopsided
prisoner exchange consisting of this one American traitor for five
Gitmo-held Taliban commanders...never mind that it was commanders who
have since returned to the Afghan theater of war...something Obama
knew well they would...just never mind all that for this was a
mid-term election year and if this prisoner swap was
“handled
properly,” as those in his administration said, it could bring
a huge mid-term win for Democratic candidates.
A hoped for election gift to the Democrats and a signed, sealed,
and delivered gift to the enemy of one Taliban commander for each
year Bergdahl was held.
“
I understand that leaving was against the law...I had no
intention of causing search and recovery operations,” said
Bowe Bergdahl's at last Monday's court martial hearing...no
intentions of being found by those on our side that is.
So with military prosecutors stating that Bowe Bergdahl committed both
the crime of desertion...as per one count of the Uniform Code of
Military Justice's Article 85: leaving one's post to shirk important
or hazardous duties...and one count of Article 99: 'misbehavior before
the enemy'...endangering the safety of a command unit or place...I say
why wasn't it added to the charges that he knowingly and willingly
put six fellow soldier's lives at unnecessary risk because he knew they
would come searching for him in known hostile territory.
Unnecessary risk all while Bergdahl
claimed
that he did what he did with the sole intention of reaching other
commanders, drawing attention to what he perceived as leadership and
safety issues within his unit...issues he said he could not
address with his unit's higher command...and then returning back to
his patrol base. And what were the issues Bergdahl was alluding to...issues
that are typical in times of war such as the removing and replacing
of officers...duties given...actions taken or not taken...nothing
that could not be addressed with his immediate higher ups.
But if by some chance what Bergdahl claims his intention was is
indeed true...twisted as it might be...why then did he plead guilty
to the charges presented. Now leaving us with important questions
that might never be answered, it is possible that Bergdahl's pleading
guilty is what he and his lawyers always had planned to do for maybe
this American traitor is hoping for leniency what with the key charge of 'misbehavior before the enemy' carrying a maximum penalty of life in prison... what with desertion punishable by up to five years in prison. And with both the
prosecution and defense not agreeing to a
“stipulation of facts”
in the case...an indication they did not reach a deal to limit
punishment...leniency...throwing himself on the mercy of the
court... might be Bergdahl's only way out.
One year in prison for desertion for each Taliban commander
released with the so serious misbehavior charge matched and then being negated
by his five years in captivity...even a traitor and his lawyers can
dream can't they.
American traitors...Bowe Bergdahl is far from the first. Starting
with the infamous Benedict Arnold all the way up to Pvt. Eddie Slovak...a
World War II U.S. Army soldier and the only American soldier
court-martialed and then executed for desertion since the Civil
War...now brings up the questions of what does and does not make desertion a charge for execution, and what does the Constitution say
about treason itself for without a charge being based upon treason
how can desertion be a death penalty charge.
Article 3, Section 3 of the Constitution states that,
“Treason
against the United States, shall consist only in levying war against
them, or in adhering to their enemies, giving them aid and comfort.
No person shall be convicted of treason unless on the testimony of
two witnesses to the same overt act, or on confession in open court.”
Fair enough in its definition
alone.
Continuing with the words, “The
Congress shall have power to declare the punishment of treason, but
no attainder of treason shall work corruption of blood, or forfeiture
except during the life of the person attainted,” means
that upon death the guilty party's crime is laid to rest with
him...as in not being transferred to surviving family members...but
Article 3, Section 3 also clearly states that Congress can adjudicate
whatever punishment it deems meets a justly tried and convicted
traitor's level of treason.
So with Bergdahl facing up to five years
in prison for desertion, and as I write this, a still undetermined
number of years for 'misbehavior before the enemy'..misbehavior as
in 'aiding and abetting' the Taliban...do Bergdahl's acts committed
meet the definition of treason no matter that he plead guilty to the
two charges levied against him. And if the prosecution can prove said
charges do meet the Constitutional definition of treason is it enough
to get Congress involved in Bergdahl's sentencing what with the fact
being that just because one is given the right to do something does
not always mean it will get done. And not getting done is more truth
than supposition especially with a sitting Congress who, while
holding the Republican majority, is overrun with both Rino's and
obstructionists.
Now as for the charge of
desertion itself...do Bowe Bergdahl's actions meet the criteria for
treason and in return a possible sentence of death...I believe they
do. And why...because while some defending him say he is a
“fragile young man”...a
young man who had previously been discharged from the Coast Guard for
psychological reasons...as in “adjustment disorder with
depression”...the fact is that
others have deserted their units during the Iraq and Afghan wars, but
what makes Bergdahl’s case different is that he did so while on the
battlefield thus deliberately putting his fellow soldiers in harm's way...sort of
like him setting them up to be 'sitting ducks'...bang bang another
American troop dead.
And the blood of those six American
troops who comprised the aforementioned search and recovery mission is
directly on Bergdahl's hands for if this coward had not run away to
hide in the woods...to take up with the enemy...those six Americans
would most probably be alive today.
So Bergdahl's act of desertion, I
believe, does meet the criteria for additional charges of treason to
be levied against him for Bergdahl showed deliberate and total
disregard for the consequences of his actions as he knowingly brought
'aid and comfort' to the enemy...an enemy who relished in the fact
that they could now add six more American dead to their mounting
body count. And that's not even counting what many soldiers in
Bergdahl's platoon stated when being interviewed...that enemy
attacks...some with casualties... greatly increased against U.S. forces in
Paktika province in the days and weeks following Bergdahl's
disappearance...with logic now dictating what if anything did
Bergdahl tell his captors that afforded this increase in
a
ttacks...where none had been
expected...an increase that could only be courtesy of a squealer.
And without the now proven
possible charge of treason being added to the desertion charge
Bergdahl could face as little as five years in prison...less than
even one year for each of the six soldiers killed because of his
willful actions. So that leaves the charge of 'misbehavior before
the enemy' to hopefully see justice served, but even that serious
charge...a charge one step short of treason and a charge rarely used
since World War II...carries with it a maximum punishment of
confinement in prison for life. And sadly in Bergdahl's case that
means decades of life lived on our taxpayer dime...monies wasted on a
traitor...while six of his fellow soldier's blood remain forever
stained on his hands.
Now I leave you with this and it relates to my earlier 'more on
this in a bit' in regards to the fact that Bowe Bergdahl never wanted
to be found...at least not found by those on our side.
In his last email to his parents, an email sent on June 27, 2009,
Bowe Bbergdahl wrote these words, and I quote,
"The future is
too good to waste on lies and life is way too short to care for the
damnation of others, as well as to spend it helping fools with their
ideas that are wrong. I have seen their ideas and I am ashamed to
even be an American. The horror of the self-righteous arrogance that
they thrive in. It is all revolting. I am sorry for everything here."
Adding that,
"These people need help, yet what they get
is the most conceited country in the world telling them that they are
nothing and that they are stupid, that they have no idea how to
live...I am disgusted with the Army.”
And if for no other reason than
those shameful words said, Bowe Bergdahl can, in my opinion, either
hang by the neck until dead or be riddled with bullets by a firing
squad, for not one bloody dime of our taxpayer dollars should ever be
wasted keeping this America-apologizing, traitorous stain on our
country alive.
Now let true justice be served.
