Op-ed: 
'True Threats' of Violence...More Than Just Media Fodder

Well folks Donald Trump is spewing words of instigation yet again…this time going way beyond just the absurd about his supporters not caring if he shot somebody while walking down Fifth Avenue; even going beyond his not outwardly condemning the recent violence in Chicago that led to his claiming that his First Amendment right to free speech had been violated...which by the way it was not.

Now Trump is actually putting the Republican delegates and the Republican hierarchy on notice with threats that if after the primaries he does not reach the magic number of 1,237 needed to secure the nomination...and know there is nothing nefarious about that number as it's simply half the delegates plus one...in other words the majority...that should he nevertheless finish with the most delegates no matter the number, and if the nomination were to go to someone else that violence could result...as in his words, “I think you’d have riots.”

Speaking by phone this past Wednesday on CNN's 'New Day' with Chris Cuomo, Donald Trump stated that he's “representing many millions of people”...completely ignoring the fact that the other two candidates still in the race, Ted Cruz and John Kasich, can say the exact same thing. Then by adding that, “If you disenfranchise those people, and you say, ‘I’m sorry, you’re 20 votes short or 100 votes short and we’re at 1,100 and somebody else is at 500 or 400…I think you’d have problems like you’ve never seen before. I think bad things would happen...I think you would see problems like you’ve never seen before. I think bad things would happen. I really do. I wouldn’t lead it, but I think bad things would happen,” Trump has actually tried to blackmail the GOP...as in 'give me the nomination contested or otherwise or else'...thus making Donald Trump no better than the thugs and hoodlums that he so loves to call out. And know that this latest stunt of his will be turned into yet another soundbite...just like Chicago was...that the media will report on ad-nauseum, thus denying both Cruz and Kasich their rightful air time.

And it's the media...the very ones whose 'bought-and- paid-for' ratings whore existence revolves around 'The Donald Trump Presidential Reality Show'...who wait with baited breath to see if Trump's words are legally an actual threat or just wishful thinking on his part...wishful thinking by the man who, like Barack HUSSEIN Obama, thinks himself king...and if he's not perceived as king he'll buy, if you will, your undying loyalty...just ask Dr. Ben Carson.

And while being quick to tell Cuomo that he himself won’t lead any riots...I personally believe he'll just orchestrate them from behind...Donald Trump made sure in the interview to stop legally just short of directly threatening violence. But know that nowhere in his words did Trump denounce or discourage violence...which would have been the honorable thing to do...thus proving himself to be what many of us have thought since day one...that Donald Trump is nothing but a thug in a multi-billionaire disguise. And now add in the many talking heads...especially FOX's Sean Hannity who has been in the tank for Trump since the moment he announced his run...who love to feed into and help perpetrate the Trump mantra about riots breaking out at the convention if he were denied the nomination. After all, violence of any kind is a ratings bonanza and the masses so relish in watching Donald Trump vs. the GOP establishment show, that it's now become yet another blood sport.

And what has the reaction of the Republican party hierarchy been to Trump's rhetoric of possible riots if he's denied the nomination even if he doesn't reach the must have 1,237 number...“Well first of all, I assume [Trump] is speaking figuratively,” said RNC Chief Strategist Sean Spicer, who went on to say that the convention is just part of the process, and that the Trump campaign will not receive any special treatment, and that he will not be voted up or down based upon anything other than the will of the delegates and whatever wheeling and dealing that happens on the convention floor, both for or against Trump.

In other words, the convention would still go contested but not brokered, with the all important difference being that in a brokered convention a party committee picks the nominee while in a contested convention the delegates themselves make that decision having been released from their pledge after the first balloting. And really there is nothing wrong with that especially since some members of the RNC are working towards being more transparent on the convention floor by trying to replace the currently used 1,500-page Parliamentary Handbook of the U.S. House with Robert's Rules of Order. And while Robert's simpler procedures and rules still would not guarantee Donald Trump the nomination it will at least thwart any underhanded dealings to deny him the nomination if he reaches the all-important 1,237 number.

But even with the RNC at least trying to work things out fairly for all parties concerned, if truth be told Trump's threatening, instigating, or even just alluding to riots or violence is, in my opinion, reason enough to deny him the nomination as threats of violence against individuals, according to the Supreme Court (Watts v. United States), fall outside First Amendment protection and are arrestable offenses. Citing three main reasons why 'true threats' of violence are not protected rights, the High Court has stated that, “protecting individuals from the fear of violence, from the disruption that fear engenders, and from the possibility that the threatened violence will occur,” takes precedence over the right of someone to spew words instigating violence.

In fact, the Ninth Circuit has stated that a 'true threat' is “a statement which, in the entire context and under all the circumstances, a reasonable person would foresee would be interpreted by those to whom the statement is communicated as a serious expression of intent to inflict bodily harm upon that person,” adding that “It is not necessary that the defendant intend to, or be able to carry out his threat; the only intent requirement for a 'true threat' is that the defendant intentionally or knowingly communicate the threat.” And Donald Trump has said time and again that anything he says is true...meaning even his alluding to or wishing for possible violence can and should be taken as a 'true threat.'

And while Justice Learned Hand, a champion of free speech, stated in his 1917 opinion 'Masses v. United States' that even dangerous 'dissident speech' was somewhat protected under the First Amendment, he conceded that government could regulate and call to task any speaker who would "counsel or advise a man" to commit an unlawful act...which is exactly what Donald Trump did with his threats about bad things happening if he is denied the nomination.

And even if Trump's 'true threat' words were to be dismissed...which I believe they should not be what with the pattern of violence at his rallies and events increasing while he feeds into it with vile rhetoric (see my Right Side Patriots partner and friend Craig Andresen's and my joint article about just that here: http://thepatriotfactor.blogspot.com/201...)...it must also be noted that Trump's words about possible riots are nothing but a ploy...a scare tactic...to disenfranchise voters into not voting at all if the delegates or the party award the nomination to anybody but him. In fact, Donald Trump has even stated that if he does not get the nomination that he will bring charges that a contested convention is illegitimate, and that he will advise his many supporters not to back the nominee so as to do as much damage to the Republican party as he possibly can.

And folks, if that is not yet another threat then seriously I don't know what is.

So now while Donald Trump's 'true threats' seem to be taken as nothing but made-for-TV media ratings fodder, we are left with a game of mathematics...will Trump reach the 1,237 number needed for the nomination before it goes to convention or will Ted Cruz or John Kasich be able to stop him. And let's be honest here...John Kasich with his lowly 68 delegates has no chance of stopping Trump before the convention, while Ted Cruz has an outside chance of pulling it off...that is if he can pull 78% of all the remaining delegates from the states who have not yet voted into his corner. It's a long shot but it can be done if he can secure former candidate Marco Rubio's 170 delegates once they are released...or better yet if a deal is worked out and announced before the convention for a Cruz/Rubio ticket.

Now that is something I could go for and a ticket like that would steamroller over Hillary in a heartbeat. And it would also knock the wind out of both Donald Trump's campaign and any words he could say because together Cruz and Rubio have more delegates and support than Trump...and no threats made and no hopes of violence can counter numbers...it truly is that simple.

A few questions of 'so when'...

So many questions that need answers...so many answers that will probably NEVER be gotten...

So when is Sean Hannity (and now Mike Huckabee as well) going to apologize to Cliven Bundy for the nasty things he said about the very man standing strong against a federal government run amok. Calling him a racist and such Hannity...of all people...listened to the New York Times edited version of Bundy's 'supposed' racist remarks instead of listening to the entire unedited interview. And with this liberal rag of a newspaper doing what Hannity should have known they'd do...as in editing, splicing, and pasting together Bundy's words to fit their leftist agenda...the saddest thing of all is that Sean Hannity fell for it. Shame on him but now he needs to make amends and do so by putting on his big boy pants, man-up by eating some crow, and apologize 'ON-AIR' to Cliven Bundy for listening to and accepting as facts the words of the likes of The New York Times...case closed.

So when are those here in our country who think there's a Republican 'War on Women' going to wake up and realize that it's the left...the Democrats as in Obama and crew...who NOT only are the ones perpetrating the LIE about a 'War on Women' here at home but who actually condone the inequality women face in many parts of the world. Condone it for NO objection was raised by our American delegation to the U(seless) N(ations)...on Obama's orders perhaps...when Iran was unanimously elected to the U.N.’s Commission on the Status of Women (CSW), a commission dealing on a global level with gender equality and the advancement of women. So now Iran again sits on this all-important commission with nary an objection by any delegation even knowing their dismal record on women's issues...doing NOTHING even when given the opportunity to speak-up against this appointment.

Iran, the country where the hijab is mandatory dress for all woman venturing out into the streets and public places...Iran, the country where divorce is a husband’s right but where a woman must prove her husband has either abandoned her, is mentally ill, abusive, or a drug addict, for her to get a divorce...Iran, the country where child custody, inheritance, and ownership laws side overwhelmingly with the man...Iran, the country where women are NOT allowed to be judges or hold high-ranking positions in the government...Iran, the country where honor killings are the acceptable norm and adultery is a crime that holds the woman accountable for the very evidence that will be used against her, and where her testimony is worth half that of a man’s...that very country will continue to sit on a commission dealing with women's rights and equality. But hey...this goes hand-in-hand with Obama's pandering and acquiescing to his islamic brethren by his allowing Iran to pull the wool over the world's eyes concerning the issue of their becoming an anything but peaceful nuclear power.

So when are the leaders of the G7 nations...the leaders of the now anything but 'free world'...going to accept the fact that their mere condemnation of Putin's actions in and around Ukraine...actions that could escalate into a larger conflict that could devour the entire region...and their slapping of even more useless albeit targeted sanctions on Russia all while Russia counters them by raising interest rates for a second consecutive month in an effort to limit the economic damage caused by these very sanctions...will amount to absolutely NOTHING against a man hell-bent on rebuilding the Russian Empire.

When will they realize that imposing sanctions of any sort instead of sending a strong united military show of force to the area...and the token 600 troops Obama is sending to the area is NO show of force...will NOT get the 'Russian Bear' to pull back his troops. When will these leaders realize that Vladimir Putin is the winner of this game as he orders new military drills near the border with eastern Ukraine and as Russian aircraft enter Ukrainian airspace, doing so as he sits back and laughs over how far down the path to humiliation and defeat his American counterpart, Barack HUSSEIN Obama, has led our beloved country...how far down this path he, Vladimir Putin, has manipulated and played the president of the world's last remaining superpower.

So when will Barack HUSSEIN Obama stop beholding our country to his muslim brethren in regards to keeping us dependent on Arab oil. When will he approve the building of the Keystone XL Pipeline that would put thousands of Americans back to work and help them get off the government welfare rolls and us away from OPEC oil price manipulation. When...probably NEVER...NOT even after the November mid-term elections for to do so would take away people's allegiance to the party that feeds them and would raise the ire of those this miserable excuse of a president caters, panders, and bows down to.

So when will this administration finally get it that the once-called 'Roadmap to Peace'...the now 'anything but peace talks' between the Israelis and the Palestinians...is over and that it NEVER had a chance to succeed for trading land for peace will NOT now or ever work when those who want the land want ALL of the land. And when the talks involve a two-faced desert rat like Mahmoud Abbas, a man who would rather make deals to form a 'unity government' with Hamas terrorists who "will not give any cover for any negotiations with the enemy" than make peace with Israel, you just know the time has come to pack your bags and go home. That is go home and let Israel do what Israel needs to do to ensure its survival now and forever.

So when will Hillary 'What Does It Matter' Clinton finally accept the fact that we patriots will NOT ever allow her to forget her role in the murders of four Americans at Benghazi. And she knows we know what she is so trying to hide and that it will haunt her every move if she dares choose to run for president in 2016. So when will we finally get to the bottom of why the feds really want Clive Bundy and his cows off 'public' lands...and when...and I want a date for this one...when can we finally get rid of the monstrosity know as ObamaCare.

So again, so many questions that need answers...so many answers that will only be gotten when hell freezes over or when some brave soul decides to put America first and sings like the proverbial canary...but sadly I will NOT hold my breath for that one.

Stick and stones might break bones but big mouth Democratic governors do send people
packing

By now we all know that last Friday in a radio interview, ubber liberal New York Governor Andrew Cuomo caused quite a stir when discussing the split in the Republican party...a split between the moderates... translation: the RINOS...and the true conservatives of the party who he accused of being anti-abortion, anti-gay rights, pro-assault weapons, and pro-Second Amendment...which by the way they are, but it's what Cuomo said after that has raised the ire of conservatives everywhere NOT just in New York.

Needing moderate RINO support and endorsements for his 2014 re-election bid, especially from those in big money Democratic electorates on Long Island and in Westchester county he asked, “Who are they?...Are they these extreme conservatives, who are right to life, pro-assault weapon, anti-gay? Is that who they are? Because if that is who they are and if they are extreme conservatives, they have no place in the state of New York.’’ 

And the fallout from his verbal diarrhea started almost immediately and damage control went into full operational mode. And true to Democratic form, Cuomo's people claimed in an open letter to the editor of the New York Post that his words were “distorted” and that Cuomo wasn't talking about individuals per se, but was talking about conservative candidates wanting to run in his state.

“It is clear that the governor was making the observation that an extreme right candidate cannot win statewide because this is a politically moderate state (either moderate Republican or moderate Democratic),” the letter stated.

Yeah right...for Cuomo's people took a page directly from the Obama playbook of NOT taking responsibility for what came out of one's own mouth...just like when Obama tried to claim that "If you like your insurance...if you like your doctor...you can keep them...period" was taken out of intended context...and did what was expected of them as they covered-up with lies Cuomo's words in an effort to divert and deflect the masses away from the vileness spewed by this angry, leftist-leaning, party-loyal, conservative hater.

And anyway NO matter how his people try to temper down the so-called 'intended meaning' of  Cuomo words, NO lies now said can cover for the fact that nowhere in Cuomo's statement is the word 'candidate' mentioned or even alluded to.

And as the initial the firestorm cleared, what remained from Cuomos's very own personal 'Bridgegate' is the question of why is he pushing so hard to win over the moderate (RINO) Republicans...simply, it's because he's losing support from the base...those wealthy big money left-wing progressives who are needed NOT just to finance his campaign...a campaign with a current war chest of 33 million dollars...but also to stir up the Democratic masses against any and all opposition. And the fact that he's already at odds with recently elected NYC Mayor Bill de Blasio, with State Attorney General Eric Schneiderman, with State Comptroller Tom DiNapoli, and with Assembly Speaker Sheldon Silver...does NOT bode well and can hurt his chances for re-election...for you NEVER want to alienate those high ranking officials within your own party NO matter the amount in your war chest.

In fact, Westchester County Executive Rob Astorino, who's considering a run for governor himself, said of Cuomo’s far left radical comments, “New York already leads the nation in chasing away its own citizens because of extraordinary high taxes, so does Cuomo really want to bully millions more away?’’

And how right he is for although New York is a blue state, the Republicans are in possession of great sums of money the state needs and collects in taxes...just ask those like Donald Trump who pay into the state coffers millions in taxes every year. But those are the very people leaving New York, in fact a 2012 Tax Foundation study found that over taxation was the cause of 3.4 million New Yorkers leaving the state over the past 10 years. And businesses are right behind in the exodus...to a tune of $46 billion in taxable income...because in addition to the burdensome taxes they're also over regulated to the hilt.

These stats alone will amaze you...New York has a top progressive income tax bracket of nearly 9%, with New York City itself adding on 3.5% in additional taxes...which newly elected far-left Mayor de Blasio wants to increase. Add to that a New York gift tax, a gasoline and cigarette tax, property taxes, and an estate tax that averages about 11%. And when you add to that county and city sales taxes that average between 7% and 8.9%, you can see why New York's loss is Florida's economic gain as most of those leaving are coming to Florida. Florida is known as being a business friendly state with right-to-work laws...and this is a biggie...Florida has NO income tax, NO estate tax, and NO inheritance tax, and as an added bonus our local governments cannot impose any such levies as per Florida State Statutes.

And New Yorkers are leaving because of the game playing done by people like Governor Cuomo... true Democratic politician that he is...a man who puts party politics before the needs and wants of the people who elected him. Case in point...Cuomo, just like Obama, vetoes measures that pass both Houses if they do NOT conform to his personal views and party platform. And New Yorkers, just like many across the country, are plain sick and tired of this partisan nonsense with decisions made to benefit 'the party' alone. And last year to prove this point, Cuomo vetoed 82 House passed bills..and NO great surprise here...the vast majority were bills proposed by Republicans...like the one which providing a disability benefit to sheriffs, deputy sheriffs, and correction officers if they become physically or mentally incapacitated as a result of the actions by a civilian at a local jail or other county institution.  Cuomo couldn't wait to put his veto on that one.

And so while NY State Republican Party Chairman Ed Cox is calling for Cuomo to apologize, "I call upon Governor Cuomo to apologize to New York's good conservatives and Catholics for his statement that they 'have no place in the State of New York' and to all New Yorkers for poisoning New York's politics with divisive rhetoric at a time when New York needs to be united to address its continuing economic problems"...apologizes issued just to placate the politicians and sooth the hurt feelings of the masses amounts to just empty words.

And if truth be told, the only thing that can throw a wrench into the leftist agenda and hit them where it counts...in the pocketbook and state coffers...is what New Yorkers like FOX News conservative pundit Sean Hannity said and what a lot of everyday conservative New Yorkers are now feeling, "I'm not welcome in my own home state...that's fine. Governor Cuomo, I'm going to leave and I'm taking all of my money with me — every single solitary penny."

And to that I say, "Sean, you're welcome in Florida anytime."
